Welcome to ImotoHub, an online marketplace connecting individuals and businesses for the purpose of buying and selling vehicles in South Africa.

By accessing or using ImotoHub, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. Definitions

  • "Platform" refers to the ImotoHub website and any related services or applications.
  • "User", "you", or "your" refers to any individual or business who accesses or uses the Platform.
  • "We", "us", or "our" refers to the operators of ImotoHub.
  • "Warehouse" refers to your private vehicle inventory (visible only to you).
  • "Showroom" refers to the publicly visible listings made available through the Platform.

2. Eligibility

To use this Platform, you must:

  • Be at least 18 years old;
  • Reside in South Africa;
  • Have the legal capacity to enter into a binding agreement;
  • Agree to comply with all applicable laws, including vehicle sales and consumer protection regulations.

3. Account Registration

You must register an account to use core features, including listing vehicles. You are responsible for:

  • Providing accurate and up-to-date information;
  • Keeping your login credentials secure;
  • All activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate our terms or harm the platform's integrity.

4. Listing Vehicles

When listing a vehicle:

  • You warrant that you are the legal owner or authorized seller of the vehicle;
  • You must provide accurate, truthful, and complete information;
  • You must clearly disclose any known issues with the vehicle;
  • You may not list stolen, cloned, or otherwise illegal vehicles.

We reserve the right to remove or suspend listings that are misleading, unlawful, or otherwise violate these Terms.

5. Use of Warehouses and Showrooms

  • Users may add vehicles to their personal Warehouse at no cost;
  • To publicly list a vehicle, it must be placed in your Showroom, which may require a paid subscription or listing fee;
  • Users are responsible for managing their showroom space, and expired subscriptions may result in delisting.

6. Payments and Subscriptions

  • Certain features, including Showroom slots or promotional visibility, may be subject to subscription or once-off payments;
  • Payments are handled securely via approved third-party providers such as PayFast;
  • Fees are non-refundable unless otherwise stated or required by law;
  • Failure to pay may result in suspension of your listing or account.

7. Buying and Selling Vehicles

  • ImotoHub does not buy, sell, or take ownership of any vehicles listed;
  • All transactions are conducted directly between users;
  • We do not verify the identity of users or guarantee the condition of any vehicle;
  • You are solely responsible for conducting due diligence before completing any transaction.

8. User Conduct

You agree not to:

  • Post or transmit false, misleading, or defamatory content;
  • Upload or share harmful software, spam, or malicious code;
  • Violate any applicable law or infringe on any third-party rights;
  • Impersonate others or use multiple accounts to manipulate visibility.

9. Support and Disputes

  • For all questions or support queries, please use our Ticket Support System available on the website;
  • We aim to respond to all tickets within a reasonable timeframe;
  • We are not liable for disputes between buyers and sellers, but we may intervene in cases of suspected fraud or abuse.

10. Intellectual Property

All content on the Platform (including the brand, design, and software) is owned by or licensed to ImotoHub. You may not copy, reproduce, or distribute any part of the Platform without our express written consent.

11. Limitation of Liability

To the extent permitted by law:

  • We are not responsible for losses, damages, or disputes arising from use of the Platform;
  • We do not guarantee uninterrupted or error-free operation of the Platform;
  • The Platform is provided "as is" without warranties of any kind.

12. Termination

We reserve the right to suspend or permanently terminate your access to the Platform without notice if we believe you are violating these Terms or acting in bad faith.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of the Platform after changes are published constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms shall be resolved in South African courts.
